The present General Conditions of Use, Conditions of Sale and Privacy Policy, regulate the use of the website, “ARTESANIALATINA.NET”.

These Terms are important to both you and us as they are designed to create a legally binding agreement between us protecting your rights as a customer and our rights as a company.

We shall not be obliged to supply you with any other products that may have been the subject of your order until we confirm the dispatch of those products in a separate Dispatch Confirmation.
Article 3. Availability
Availability of service: The stock items offered through this website are available in the countries listed in the “Shipping and Returns” section.
EXCELLENCE MODEL KITS S.L. reserves the right to unilaterally cancel the order, refunding any amount you may have paid.
EXCELLENCE MODEL KITS S.L. will do its best to satisfy all its customers' demand for the products. However, all orders for products are subject to availability and, in this regard, if supply difficulties occur, or if there are no items in stock, we reserve the right to provide you with information about substitute products of equal or superior quality and value which you may order. If you do not wish to order such substitute products, we will refund any amount you may have paid.
Article 4. Delivery
EXCELLENCE MODEL KITS S.L. undertakes to deliver the products in perfect condition to the delivery address indicated by you on the order form. You can request the delivery of the articles, in another address and to another physical person different from the one who subscribes the order, as long as the delivery address is subject to the availability of our service (see previous section).
Orders will only be delivered to PO boxes under certain conditions.
In order to optimise delivery, we kindly ask you to indicate an address to which the order can be delivered during normal working hours. EXCELLENCE MODEL KITS S.L. is delivered by leading courier companies. EXCELLENCE MODEL KITS S.L. will make available to the customer all the information about your shipment (such as the tracking number, for example) of the agency by which the shipment will arrive and the telephone number of the courier company, so that you can contact them and know at all times the location of your shipment.
The delivery of the goods will be made at the address designated by you, except in the repeated absence of the addressee or if the weight, volume or characteristics of the goods do not allow a single person to handle them, in which case, with prior notice, they will be delivered at the door of the street or at the destination office. In case of absence of the addressee, at the time of delivery, a receipt will be left indicating how to proceed to arrange a new delivery. EXCELLENCE MODEL KITS S.L. reserves the right to vary the type of delivery and the company by which it is made, independently of what is stated in these pages and as long as it does not suppose a manifest prejudice for the client.
Non-compliance with the delivery time will not be considered to be that caused by the absence of the recipient; change of address; unknown address; lack of name, telephone and e-mail contact details in private addresses; non-payment of postage; replacements or refunds; closure due to holidays; late deliveries on the second delivery attempt; and causes of force majeure, fortuitous event or others not attributable to the transport company.
The service will not be available for deliveries and collections in the postal addresses included in the list of conflictive areas provided by the transport agencies we work with.
The shipping costs of the items purchased will be reflected in the final moment of the purchase and will depend on the chosen mode, urgent or normal and the place of destination. These conditions may be modified. For the purposes of these Conditions, it will be understood that “delivery” has taken place or that the product/s have been “delivered” at the moment of signing the receipt of the same at the agreed delivery address.
Delivery timesWe work
with the following delivery times:
- Shipments to mainland Spain and the Balearic Islands: delivery in 24 to 72 hours.
- Other destinations: delivery in 4 to 20 working days.
We will understand these delivery times in working days (Monday to Friday) and for orders placed in ARTESANIALATINA.NET before 12 noon and for products in stock. Please note in any case that we do not deliver on Saturdays or Sundays.
Impossibility of delivery:
We reserve the right to withdraw any product from our website at any time and / or to remove or modify any material or content thereof. Although we will do our best to always process all orders, there may be exceptional circumstances which require us to refuse to process any order after we have sent the Order Confirmation, and we reserve the right to do so at any time, at our sole discretion.
We will not be liable to you or to any third party for removing any product from our website ARTESANIALATINA.NET, regardless of whether or not such product has been sold, remove or modify any material or content of the website, or for refusing to process an order once we have sent you the Order Confirmation.
Article 5. Pricing
For orders for destinations within the European Union, the prices shown on our website include Spanish VAT at 21%.
For export orders to destinations outside the European Union, the prices shown on our website are the final price excluding taxes.
Shipping costs are variable and depend on the destination. For more details, please see the corresponding section, SHIPPING AND RETURNS.
The PRICE OF THE PRODUCTS will be the one shown on the website and only applies to purchases made through the Internet. The price is expressed inclusive of taxes, as these taxes are fixed on the date of acceptance of the offer. The price must be paid in full at the time of purchase.
EXCELLENCE MODEL KITS S.L. reserves the right to modify at any time the selling prices shown on ARTESANIALATINA.NET, but the articles will be invoiced on the basis of the rates in force at the time the order is registered subject to availability on that date.
Article 6. Payment
Orders may be paid for using the following methods:
- Payment by credit or debit card. We reserve the right NOT to accept certain payments with certain credit cards.
- Payment by PayPal (when certain conditions are met).
- Payment by bank transfer (for spare parts orders and for orders from countries not included in the “Shipping and Returns” section.
EXCELLENCE MODEL KITS S.L. reserves the right to change the methods of payment, being able to create new ones or eliminate some of the existing ones, without the user/customer of ARTESANIALATINA.NET being able to make claims for this reason. However, if the change in the method of payment affects an order already placed, from ARTESANIALATINA.NET we will contact the customer to inform him of the change, offering the option to cancel the order if deemed appropriate.
- Payment by credit/debit card.
The charge is made online, that is to say, in real time, through the payment gateway of the corresponding financial entity and once it has been verified that the communicated data are correct. In order to give the maximum security to the payment system ARTESANIALATINA.NET uses secure payment systems of first line financial entities in electronic commerce.
In this sense, the confidential data are transmitted directly and in encrypted form (SSL) to the corresponding financial entity. The SSL encryption system that we use confers total security to the transmission of data through the network. Your data is completely confidential and protected.
Credit card details are not recorded in any of our databases. They are only used in the virtual POS (Point of Sale Terminal) of our financial institution, through its Secure Payment Gateway.
Credit cards will be subject to checks and authorizations by the issuer of the same, but if the entity does not authorize payment, we will not be responsible for any delay or non-delivery and we can not enter into any contract with you.
EXCELLENCE MODEL KITS S.L. reserves the right to verify the personal data supplied by the customer and to take the measures it deems appropriate (including the cancellation of the order) to ensure that the goods purchased are delivered in accordance with the data contained in the order.
- Payment with PayPal:
Payments with PayPal are made directly on the PayPal website, following the conditions of use established by PayPal. If the order is not paid within one hour, the order will be considered cancelled.
- Payment by bank transfer for the purchase of spare parts and for orders from countries not included in the list of shipments on the website:
Payments by bank transfer can only be made to purchase spare parts from our central warehouse so that you can complete your model or repair your tool, as well as for orders from countries not included in the list of shipments on the website. When requesting a part/s, please send an email to web@artesanialatina.net and indicate the references of the part/s and the model you own, as well as your full name, address, telephone number and ID card, passport or national identification number. We will reply with a quotation and if you agree with this you will proceed to make the transfer. Once completed, send an email to the same address with proof/receipt of the transfer. Once it has been checked in our system, the requested part/s will be sent immediately.
When requesting a model or tool, send us the reference of the product you want with the same data as when requesting a part. The process is absolutely identical.
Article 7. Return policy
The customer will have 14 days to check the integrity of all the components of the order and to check that everything that should be included in the products included is included. After these 14 days, the shipment will be considered as accepted and no claims will be accepted for damages or faults with the shipment.
In case of receiving a product damaged by transport it is advisable to contact us within the first 24 hours to be able to claim the incident to the transport company. In the same way, it is essential to leave a record to the transport company through the delivery note of the goods (putting “pending review” is enough)
How to exercise your right to withdrawal
If you are not satisfied with the products purchased, you have been confused in your order or simply do not want them anymore, if you have not yet opened it and keep its original packaging, you only have to follow the following steps.

- Send us the product(s) to be returned within 14 days from the date you notified us of your intention to return the product(s).
- You must pack the products in the same protective box in which you received them or in one of similar characteristics and include the delivery note inside.
- Send it by courier to our warehouse:

You must bear in mind that you will have to pay the return shipping costs. In the case of large products, please do not hesitate to contact us in case we can offer you a more economical collection service. After receiving the returned products and once we have checked that they are in perfect condition, we will refund the amounts of the returned products but not the costs of handling, collection or shipping. The refund will be made within 14 days of receipt of the returned goods. If the product was paid for by credit or debit card, or by PayPal, the credit will be made to the same. Otherwise, we will ask you to send us by email a bank account number to make the corresponding payment.
Returns of defective products
If you have received a defective or wrong product, you must contact us immediately, within 7 days of receipt, either by telephone: (+34) 689 578 269 or email: web@artesanialatina.net and providing the details of the product as well as the incident. In some cases we will ask you to send us a photo of the damage or of the product/s received for verification.
Once we have received the notification, we will contact you to inform you of how to proceed.
In the event that the product(s) cannot be replaced, the amounts paid for those products that are returned, because of a defect or fault in the product, where it actually exists, will be refunded in full, including the delivery costs incurred to deliver the item (if such costs have been incurred).if
the product was paid for by Credit or Debit Card, or by PayPal, the credit will be made to the same. Otherwise, we will ask you to send us by email a bank account number to make the corresponding payment.

Article 8. Guarantee of the products purchased
According to the Royal Legislative Decree 1/2007 of the 16th of November, by which the revised text of the General Law for the Defence of Consumers and Users is approved, EXCELLENCE MODEL KITS S.L. is responsible for the lack of conformity within a period of two years from the delivery.
In the case of lack of conformity, you must inform us within two months of becoming aware of it, by sending an e-mail to web@artesanialatina.net indicating your details, the number of your order and the anomaly detected. In the case of a manufacturing defect, EXCELLENCE MODEL KITS S.L. will be responsible for the return costs, as well as the expenses related to labour and materials. The article to be returned must be correctly packed for its return. The packaging must be in perfect condition and keep all its original accessories and instructions in order to be returned.
The instructions for the correct use and installation of the product, as well as the warranty documentation included by the manufacturers, must be read by the purchaser. The warranty shall be void in the event of defects or deterioration caused by external factors, accidents, in particular electrical accidents, wear and tear, installation and use not in accordance with the Supplier's instructions. Products modified or repaired by the customer or any other person not authorised by the supplier are also excluded from the guarantee.

Article 9. Responsibility and disclaimer of liability
The photographs and texts reproduced presenting the products offered are for information purposes only. The responsibility of EXCELLENCE MODEL KITS S.L. in relation to any product purchased on ARTESANIALATINA.NET will be strictly limited, in any case, to the purchase price of the said product and will not be engaged by simple errors or omissions that may have occurred, when all the necessary precautions have been taken in the presentation of the products.
EXCELLENCE MODEL KITS S.L. cannot be held responsible for damages, whatever their nature, whether material, non-material or bodily, which may result from the improper operation or use of the products marketed. The same applies to any modifications made to the products by suppliers.
EXCELLENCE MODEL KITS S.L. cannot be held liable by a customer or a third party for indirect damage, operating loss or loss of profit occurring by any means whatsoever even if such damage, loss or prejudice would have been foreseeable by EXCELLENCE MODEL KITS S.L. or if its eventuality would have been brought to its knowledge.
Subject to the provisions of the preceding paragraphs, the liability of EXCELLENCE MODEL KITS S.L. under these general terms and conditions may not exceed an amount equal to the sums paid following the transaction at the origin of such liability, whatever the cause or form of the action in question.
EXCELLENCE MODEL KITS S.L. cannot be held responsible for the non-fulfilment of the contract signed in case of stock shortage or unavailability of the product, force majeure, interruption of the activity or total or partial strike, in particular, of the postal services and means of transport or communications, floods or fire.
The provisions of this clause shall not affect your statutory rights as a consumer, nor your right to withdraw from the contract.
In the event of a dispute, the customer may, in the first instance, contact EXCELLENCE MODEL KITS S.L. in order to reach an amicable settlement.
Article 10. Written communications and notices
Applicable law requires that some of the information or communications we send you be in writing. By using the ARTESANIALATINA.NET website, you agree that most communications with us will be electronic. We will contact you by e-mail.
In all communications and in the formulation of the contract we will use the official language of the Spanish State, Spanish.
For contractual purposes, you consent to use this electronic means of communication and acknowledge that all contracts, notices, information and other communications that we send you electronically comply with the legal requirements of being in writing. This condition does not affect your statutory rights.
Notices from you should preferably be sent to us using our contact form. In accordance with the above and unless otherwise stipulated, we may send communications to you either by e-mail or to the postal address provided by you when placing an order.
Notices will be deemed to have been received and properly given as soon as they are posted on our website, 24 hours after an e-mail is sent, or three days after the postmark date of any letter. In order to prove that service has been made, it shall be sufficient to prove, in the case of a letter, that it was properly addressed, properly stamped and properly delivered to a post office or letter box and, in the case of an e-mail, that it was sent to the e-mail address specified by the recipient.
